I really tried hard to just ignore your last comment ERN and let this die. But unfortunately I just couldn't! I guess because every time you come back and comment you make it still sound like what you did was OK instead of admitting it was wrong. You keep trivializing it and that kinda bugs me. Unfortunately there are way too many people like you out there that feel justified by stealing some hard working artist's stuff. "it's ok, were just a small band", "it's ok, how is it gonna hurt"? Gee I don't know, I guess if you can do it, I can too! And so can the horror book store here in Milwaukee I just found out was selling color-copied bootlegs of my Alice Cooper poster...or the f***- head in Canada that used my Blink 182/Green Day art to promote a multi-band show with out my permission. This needs to be taken seriously. I'm not trying to come down on just you ERN but I'm trying to make my point to a lot of people. It's one thing to use royalty free images, obscure images, even look-and-feel to a certain extent. But to take someone else's art (in-full) and use it as if you own it or created it yourself, is just plain wrong!!!
Also, your philosophy that people are gonna go to the show because of the bands and not because of the cool flyer is kinda wack! I mean, why do a cool flyer then? Why not just hand out Xerox's with plain helvetica type? One of the reasons for cool flyers and gig posters are to get people who don't know about the bands to go. I'm sure you used that zombie illo and your bloody-looking type to get across the message it was a metal show right?
Anyway...I'm done with this one, I'm getting off my soap box now. Peace.

I'm sure you're band is getting paid for the gig. I'm sure the venue is making money off people attending the show. Even if it's a free benefit event I'm sure your hoping it helps the exposure of your band. My point is you are all benefitting from someone elses work and the artist is getting nothing for it.
Not only is he not benefitting, the artist could actually be hurt by it. It might not be used in a way the artist wants. If the image starts circulating around the web he could even lose copyright control over it.
For anyone else thinking about taking another artists work and using it on a flyer...ask permission first!!!!! Most likely if the artist hears it's for a small local band show he may let you use it free or for a small licensing fee. Then at least you don't have to worry about being sued.

I really appreciate all the boyz backing up a fellow artist. When I was first informed of it I was pissed, yes. I took a look at the poster and got even more pissed(no need for comment there). Then I thought....the guy digs my art, it's a promo poster, he's not selling it(I hope, then that's another can of worms)....no big deal. I e-mailed Ern and gave him my thoughts, hopefully he'll take the write route the next time around. In my eye's this is a small offence, but it's great to see people take it very seriously and frown apond this and watch each others(the artists) backs......BIG props, thanks!

copyright infringement is an offense that artists take very seriously. We make our livings creating art and because of that we deserve to be paid for its use. We also must protect our reputation. When our work is stolen and used for other purposes we loose control over it, and therefore loose control over how it may effect our image. Not only is someone else benefiting financially from the hard work we've put into the creation of what was stolen, we are receiving no benefit of any kind.
What you are calling 3rd grade tattle-tale tactics I see as artists looking out for one another. Im actually surprised more artists haven't gotten on here and slammed you!!!
Also for your information, just because it's on the internet does not mean it's free for the taking. By law the artist that created it owns the rights to it as soon as he creates it. Copyright infringement can carry up to $100,000 dollars in statutory damages (not including legal fees). I wouldn't treat this so lightly.

it's on this site, it's open for critique. that's just my opinion.
